Welcome to Creative Warrens! By purchasing photographs or photography services from Creative Warrens, you agree to these Terms of Sale. Please read carefully.

1. Payment Terms

• All purchases must be paid in full at the time of order.

• Payments can be made via the payment methods listed at checkout, including credit card and other accepted online payment options.

2. Pricing and Discounts

• Prices are as listed on the website or provided in your personalized quote. Creative Warrens reserves the right to change prices at any time; however, changes will not apply to confirmed orders.

• Seasonal or promotional discounts (such as the current 15% discount for gallery purchases over $15) apply as specified at the time of the promotion. Discounts cannot be applied retroactively.

3. Digital and Print Products

• Digital Images: All digital image sales are final and will be delivered in the file format specified at purchase.

• Prints and Physical Products: Orders for printed images or other physical products are non-refundable, except in cases of damage during shipping.

4. Image Usage Rights

• Upon purchase, clients receive a license for personal use only. Images may not be used for commercial purposes unless specified and agreed upon in a separate commercial licensing agreement.

• Personal use includes displaying the images in homes, social media (with credit to Creative Warrens), and other non-commercial applications.

5. Returns and Refunds

• Digital Products: Digital file purchases are non-refundable due to the nature of the product.

• Physical Products: Refunds or replacements may be issued in cases where the product arrives damaged or with a defect. Please notify Creative Warrens within 7 days of receiving the product, including photographic proof of damage, to initiate a claim.

6. Order Fulfillment and Delivery

• Digital Products: Digital files will be delivered within 2-5 business days after purchase, typically through a secure download link.

• Prints and Physical Products: Please allow 2-3 weeks for printing and shipping. Creative Warrens is not responsible for shipping delays due to carrier issues but will provide tracking information when available.

7. Customization

• Custom edits to images or requests for additional editing outside the scope of the original service agreement may incur additional fees.

• Any such requests must be communicated in writing and confirmed by Creative Warrens before any work is done.

8. Customer Responsibilities

• It is the client’s responsibility to download and securely store digital files upon delivery. Creative Warrens is not responsible for lost or deleted files after delivery.

• Clients are responsible for reviewing proofs, order confirmations, and other communications promptly.

9. Privacy and Data Protection

• Creative Warrens respects client privacy. Personal information collected during the sale will be used solely for processing your order, delivering services, and, with consent, sending relevant updates.

10. Limitation of Liability

• Creative Warrens is not liable for any indirect, incidental, or consequential damages arising from the purchase or use of images or services.

11. Disputes and Governing Law

• Any disputes arising from the purchase or use of Creative Warrens’ products or services will be governed by the laws of New York State. Parties agree to resolve disputes through negotiation before pursuing legal action.

12. Changes to Terms of Sale

• Creative Warrens reserves the right to update these Terms of Sale at any time. The most current version will always be available on our website. Continued use of our services after changes are made constitutes acceptance of the new terms.
